Regulators move forward on foreclosure relief

WASHINGTON (Reuters) - Borrowers whose homes were foreclosed on during the U.S. housing crisis will start receiving payments in April from a $3.6 billion fund under a previously announced settlement with 13 banks, regulators said on Thursday.

Certain borrowers whose mortgages were serviced by one of the 13 banks can expect to receive between a few hundred dollars and $125,000, under settlements designed to end case-by-case reviews of past foreclosures.

The Office of the Comptroller Currency and the Federal Reserve in 2011 ordered banks including Bank of America Corp, JPMorgan Chase & Co, and Wells Fargo to review individual loan files after widespread mistakes were discovered in the way mortgage servicers had processed home seizures.

The reviews were initially expected to determine which borrowers were harmed and to compensate them based on their individual experiences. The process proved slow and expensive, though, with more than $1.5 billion going to consultants.

In January regulators replaced the reviews with about $9.3 billion in settlements, including $3.6 billion in cash payments to foreclosed borrowers. Struggling borrowers will receive the rest of the money in the form of assistance, including loan modifications and forgiveness.

By the end of March, regulators will provide information about the payments to borrowers who fall into one of 11 categories, including those eligible for protections under the Servicemembers Civil Relief Act, those who were not in default when foreclosed on, and those denied a loan modification, the OCC said.

Regulators are still determining how many borrowers fall into each category, OCC Deputy Comptroller Morris Morgan said on a conference call with reporters. Once they have that figure, they can calculate how much money each borrower is likely to receive, he said.

DECLINING ERROR RATE

The OCC and the Fed have faced criticism from Congress over both the reviews and the settlement that ended them. Lawmakers have asked for more information about the consultants who conducted the reviews and what they turned up.

Regulators initially said about 6.5 percent of the loans reviewed appeared to have some errors. On Thursday Morgan said that error rate had declined, but did not provide a specific figure.

The banks are expected to try to keep borrowers in their homes, but the settlement does not mandate specific kinds of relief.

The servicers will receive varying degrees of credit for modifying first and second loans, waiving deficiency judgments, offering short sales, and other types of relief.

Three servicers subject to the original reviews, Everbank, OneWest and GMAC Mortgage, did not enter into the settlements and will continue their reviews, the OCC said.

Police say woman, 22, is "person of interest" in Vegas shooting

(Reuters) - Police identified a 22-year-old woman on Tuesday as a "person of interest" in the slaying of an aspiring rapper who was shot and killed while driving his Maserati on the Las Vegas strip and for the deaths of two more people in a fiery crash that ensued.

Las Vegas police said Tineesha Lashun Howard was riding in a black Range Rover with prime suspect Ammar Harris when he opened fire on the Maserati being driven by 27-year-old Kenneth Wayne Cherry Jr. before dawn on Thursday.

Cherry, who performed under the name "Kenny Clutch," was mortally wounded and his silver sports car veered out of control, colliding with a taxicab in an intersection at the heart of the strip, near several casino resort hotels.

Harris, 26, has been the subject of a multistate manhunt since the incident, and police say he has a long criminal history that includes arrests for robbery, sexual assault, kidnapping and soliciting prostitution.

Police believe Harris is "involved in the sex trade," said Las Vegas Metropolitan Police spokesman Officer Bill Cassell.

Harris is described as having several tattoos, including a large black-eyed owl on his neck and small heart on his upper right cheek.

Police officials described Howard as a "missing and possibly endangered individual" from the Miami area.

"She's listed as a missing person," Cassell said. "How she went missing is part of the Miami Police Department's investigation."

Several photos released by the Las Vegas Metropolitan Police Department showed Howard and Harris together in each others' arms. In one of them they are seen riding in a sport utility vehicle, possibly the Range Rover.

The Range Rover used in the shooting, which bore paper dealer plates, has been impounded by police, but officials have not said where they found the luxury sport utility vehicle. No weapons were recovered from inside.

Earlier on Tuesday, Las Vegas taxicab companies pledged $35,000 toward a reward fund for information leading to the arrest and conviction of Harris.

Authorities say the dramatic shooting in a busy intersection of the desert resort city may have stemmed from a verbal altercation in the valet area of the Aria Resort and Casino a few blocks away on the Strip.

The incident took place less than a mile from where rapper Tupac Shakur was fatally shot in September 1996 while riding in a BMW with Death Row Records co-founder Marion "Suge" Knight after the two men had attended a Mike Tyson boxing match.

Shakur, 25, was hit by gunfire from at least one assailant in a Cadillac while sitting in Knight's car at the intersection of Flamingo Road and Koval Lane and died six days later at a hospital. His murder remains unsolved.

"We've partnered with some of the biggest and most influential social networks in the world, including Facebook and Ustream, to bring gamers friends into games like never before," former Gaikai CEO David Perry told attendees of Sony's PlayStation 4 event last week. It was the only mention Ustream got during the show, despite the video streaming service playing a critical role in Sony's next video game console. In-tandem with the PlayStation 4's new DualShock 4 controller and its "Share" button, users will be able to quickly upload saved gameplay video clips or directly stream their game out to the internet. The console's lead system architect, Mark Cerny, expanded on the importance of the Share button and its implications to the PlayStation 4 during last week's presentation. "Social play is so important to PlayStation 4 that we've added in hardware to support it, in the form of dedicated, always-on video compression and decompression systems," he said.

We saw a bit of the game sharing / streaming interface during Sony's presentation, but were left wondering about specifics: how will discovery work? and what of other, non-gaming Ustream content? Thankfully, Ustream CEO Brad Hunstable was able to offer up most of our answers in a recent interview. "Our goal is to allow discovery in a very clean user experience, both in discovery on the console itself and on various platforms that the content'll be available on (like Ustream, Twitter, and Facebook)," Hunstable said. He wouldn't speak to the specifics of how that discovery will work, nor would he say if you'll be able to sign-in simply using your PlayStation Network ID or if you'll have to sign up for a separate Ustream account, but he stressed that the decisions being made are, "based on what's easiest and best for the gamer." That same rubric is (thankfully) being applied to functionality. "The goal is to make sure it's very easy -- one click of a button, super simple -- and most importantly make sure it looks really, really good. And is viewable wherever people want to watch it from," Hunstable said.

How your gut keeps you healthy or makes you ill

The health of your gut determines what nutrients are absorbed and what toxins, allergens and microbes are kept out. It is directly linked to the health of your whole body. Intestinal health could be defined as the optimal digestion, absorption and assimilation of food. But that is a big job that depends on many other factors. Let?s look at a few of them ?

First, there are bugs in your gut that form a diverse and interdependent ecosystem, like a rain forest. In fact, there are 500 species and three pounds of bacteria in your gut which form a HUGE chemical factory that helps digest food, regulate hormones, excrete toxins, and produce vitamins and other healing compounds that keep your gut and your body healthy. This ecosystem of friendly bacteria must be in balance for you to be healthy. Too many of the wrong bacteria, like parasites and yeasts, or not enough of the good ones, like Lactobacillus or Bifidobacteria, can seriously damage your health.

Second, there is your gut-immune system. Your entire immune system ? and the rest of your body ? is protected from the toxic environment in your gut by a lining that is only ONE cell-thick layer. If spread out, this lining would take up a surface area the size of a tennis court, covered entirely by a sewer! If that barrier is damaged, you can become allergic to foods you may normally be able to digest perfectly well, you will get sick, your immune system will become overactive, and it will begin producing inflammation throughout your body. Filtering out the good molecules from the bad molecules and protecting your immune system is yet another important factor in gut health.

Third, there is your second brain ? your gut?s nervous system. Did you know your gut actually contains MORE neurotransmitters than your brain? In fact, the gut has a brain of its own. It is called the ?enteric nervous system? and it is a very sophisticated piece of your biology that is wired to your brain in intricate ways. Audrey Hepburn resurrected for chocolate ad

A pretty woman sits on a bus and waits for her journey to continue. She peers into her purse, eyes a bar of chocolate. Outside, a handsome man gives her a smile -- and next thing you know, she's bounding out of the bus and jumping into the stranger's car. And, of course, having a bite of that chocolate bar, all while "Moon River" plays in the background.

The pretty woman? The Oscar-winning actress and humanitarian Audrey Hepburn, who died in 1993. The scene? It may look like a lost sequence from the gamine actress' breakthrough role in 1953's "Roman Holiday" (colorized, natch), but it's actually a combination of footage shot on the Amalfi Coast in Italy (says the Toronto Sun) and a CGI resurrection of the actress -- who happened to sing "Moon River" in 1961's "Breakfast at Tiffany's."

The purpose? To sell the British chocolate bar Galaxy. But not everyone finds the pairing sweet -- critics say the ad is disrespectful to the actress, now dead for 20 years, who can't complain that her image is being ill-used. But Hepburn isn't the first famous face to come back from the dead to shill for a product -- a young Fred Astaire was used in 1997 to push the Dirt Devil vacuum, a deal authorized by his widow but dissed by his daughter, who said she was "saddened that after his wonderful career he was sold to the devil."

In Hepburn's case, she can't stand up for herself to either support or discredit the move, which means it's up to her estate to make these decisions. And her sons, who control that estate, are all for it: Sean Ferrer and Luca Dotti issued a statement saying Hepburn would be "proud" of her latest role, noting that she "often spoke about her love of chocolate and how it lifted her spirit."

They probably didn't mean that last bit literally.

Giving a voice to kids with Down syndrome

Feb. 25, 2013 ? Researchers from the University of Alberta are helping children with Down syndrome who stutter find their voice and speak with ease.

Stuttering is a common problem that affects almost half of all children with Down syndrome, yet despite the scope of the problem, little research exists about preferred treatment options -- or even whether to treat at all. Researchers with the U of A's Institute for Stuttering Treatment and Research (ISTAR) point to a new case study that shows fluency shaping can indeed improve a child's speech.

"People who stutter, whether they have a developmental delay or not, can do very well with treatment," said study co-author Jessica Harasym, a speech-language pathologist and Elks clinician with ISTAR in the Faculty of Rehabilitation Medicine. "There is no difference between the way the child in our case study responded compared with other children and families we've worked with who don't have Down syndrome."

Co-author Marilyn Langevin, ISTAR's director of research, said there is little consensus in the speech-language pathology community about treating stuttering for kids with co-existing disorders like Down syndrome. Their descriptive case study directly challenges the notion that children with Down syndrome should not be taught fluency skills for fear that failure could lead to frustration and damaged self-esteem.

"The difference in treating a child with Down syndrome might be using more simplified terms and slight modifications in how skills are explained, more modelling of skills -- the more you show, the better," Langevin says.

In the study, Harasym and Langevin worked with an eight-year-old girl, "Sarah," whose stuttering had affected her scholastic performance and ability to speak with friends and teachers at school. Four months of treatment, including the practice of prolongation -- speaking at an exaggeratedly slow rate -- plus breathing techniques and voice management skills inside the clinic and at home, helped Sarah improve her fluency by 98.6 per cent.

"This is front-line clinical research and it is making a difference in people's lives," Langevin says, explaining that stuttering can lead to social isolation, teasing and bullying. She says treatment helped Sarah find a way to get her words out, and helped with school work as well as interacting and making new friends.

"When there is less interference with communication, a child like Sarah can function that much better. She's functioning better with friends, she's functioning better with family, and she's able to reach her potential in a more robust way."

Langevin and colleagues at ISTAR plan to publish studies that report on treating young adults with Down syndrome who stutter, as well as those with Prader-Willi syndrome and other co-existing disorders.

Putting malaria on the SHELPH

Experts have disabled a unique member of the signalling proteins which are essential for the development of the malaria parasite. They have produced a mutant lacking the ancient bacterial Shewanella-like protein phosphatase known as SHLP1 (pronounced shelph). This mutant is unable to complete its complex life cycle and is arrested in its development in the mosquito. The discovery could help in the design of new drugs to arrest the spread of this killer disease.

SHLP1is critical to the cellular development of the malaria parasite. It can be found at every stage in the lifecycle of the malaria parasite and for the first time experts led by The University of Nottingham have analysed their biological function.

Dr Rita Tewari and her team in the Centre for Genetics and Genomics in the School of Biology have spent three years studying the phosphatase proteins that are important building blocks in the life cycle of the malaria parasite. The findings of their latest study are published today, 21 February 2013, in the academic journal Cell Reports.

Dr Tewari said: "SHLP1 is absent in humans and can be explored as an excellent target for malaria transmission control. Prevention of malaria transmission to and from the mosquito is vital in order to stop the devastating spread of malaria. Targeting SHLP1 could be an important step to achieve this goal."

Although great strides have been made in reducing the number of deaths from malaria, half the world's population remains at risk from the disease. In 2010 90 per cent of all malaria deaths occurred in Africa ? mostly among children under the age of five.

Dr Tewari's latest research has focused on the ancient bacterial Shewanella-like protein phosphatase (SHLP1) which is found only in bacteria, fungi, protists (organisms which paved the way for the evolution of early plants, animals and fungi) and plants.

The researchers, funded by the MRC and the Wellcome Trust, have discovered how SHLP1 controls development of the parasite at an essential stage of its life cycle. The parasite must move between human and mosquito in its quest to spread the disease. It does this every time the mosquito bites. Removing this enzyme causes defects in structures vital for invading the mosquito gut ? effectively stopping the mosquito from passing the disease on to another victim.

EIA: Several Causes for Rising Gas Prices

According to the U.S. Energy Information Administration , there are several causes for the recent rise in gas prices, including refinery outages, higher crude oil prices and the difference between the wholesale price of gasoline and the price of crude oil. Here are the details.

* The average retail price for a gallon of regular gas has increased about 45 cents since the start of the year, the EIA reported.

* One of the culprits for the increased price, stated the EIA, is what is known as the gasoline crack spread -- the difference between the wholesale price of gasoline and the price of crude oil.

* Previously, the administration has described crack spreads as a "simple measure" based on just a couple of items produced in a refinery -- generally gasoline and distillate fuel. Crack spreads do not take into consideration all refinery product revenues, however, and exclude refining costs except the cost of crude oil.

* According to the EIA, during the period between Jan. 1 and Feb. 19, the price of Brent crude oil -- the grade that drives the wholesale gasoline price in most of the United States -- rose about $6 per barrel, or 15 cents per gallon.

* Crack spreads in late 2012 were very low until, and in some cases negative as a barrel of gasoline was worth less than a barrel of Brent crude oil. The increase in the price of crude oil in December, then, resulted in higher gasoline crack spreads and may account for about two-thirds of the rise in gasoline prices since the start of the year.

* Other factors contributing to the rise in retail prices for gasoline include multiple refinery outages that have reduced the U.S. capacity to manufacture gasoline.

* According to Bloomberg Business Week , planned refinery outages will continue to be of concern, as seasonal plant maintenance usually peaks in March and April. It was noted that refineries used 82.9 percent capacity in the week that ended Feb. 5, the lowest level in 11 months.

* In addition, the EIA reported, the year-over-year global product demand for petroleum is up and expected to rise even more. The rise in demand impacts domestic refinery utilization rates, maintenance needs and product balances.

* Preparation for the seasonal switch to summer grade gasoline have continued to also add to the short-term volatility of gas prices, the EIA reported.

Murder mystery swirls around Cleopatra's sister

Researchers have reconstructed the face of Arsinoe IV, Cleopatra's sister, based on measurements from a skull discovered in Ephesus.

A Viennese archaeologist lecturing in North Carolina this week claims to have identified the bones of Cleopatra's murdered sister or half-sister. But not everyone is convinced.

That's because the evidence linking the bones, discovered in an ancient Greek city, to Cleopatra's sibling Arsinoe IV is largely circumstantial. A DNA test was attempted, said Hilke Thur, an archaeologist at the Austrian Academy of Sciences and a former director of excavations at the site where the bones were found. However, the 2,000-year-old bones had been moved and handled too many times to get uncontaminated results.

"It didn't bring the results we hoped to find," Thur told the Charlotte Observer. She will lecture on her research March 1 at the North Carolina Museum of History in Raleigh.

Bloody family history
Arsinoe IV was Cleopatra's younger half-sister or sister, both of them fathered by Ptolemy XII Auletes, though whether they shared a mother is not clear. Ptolemaic family politics were tough: When Ptolemy XII died, he made Cleopatra and her brother Ptolemy XIII joint rulers, but Ptolemy soon ousted Cleopatra. Julius Caesar took Cleopatra's side in the family fight for power, while Arsinoe joined the Egyptian army resisting Caesar and the Roman forces. Rome won out, and Arsinoe was taken captive. She was allowed to live in exile in Ephesus, an ancient Greek city in what is now Turkey. However, Cleopatra saw her half-sister as a threat and had her murdered in 41 B.C.

Fast forward to 1904. That year, archaeologists began excavating a ruined structure in Ephesus known as the Octagon for its shape. In 1926, they revealed a burial chamber in the Octagon, holding the bones of a young woman.

Thur argues that the date of the tomb (sometime in the second half of the first century B.C.) and the illustrious within-city location of the grave point to the occupant being Arsinoe IV herself. Thur also believes the octagonal shape may echo that of the great Lighthouse of Alexandria, one of the Seven Wonders of the Ancient World. That would make the tomb an homage to Arsinoe's hometown, Egypt's ancient capital, Alexandria.?

Controversial claim
The skull attributed to Arsinoe disappeared in Germany during World War II, but Thur found the rest of the bones in two niches in the burial chamber in 1985. The remains have been debated every step of the way. Forensic analysis revealed them to belong to a girl of 15 or 16, which would make Arsinoe surprisingly young for someone who was supposed to have played a major leadership role in a war against Rome years before her death. Thur dismisses those criticisms.

"This academic questioning is normal," she told the News-Observer. "It happens. It's a kind of jealousy."

In 2009, a BBC documentary, "Cleopatra: Portrait of a Killer," trumpeted the claim that the bones are Arsinoe's. At the time, the most controversial findings centered on the body's lost skull. Measurements and photographs of the incomplete skull remain in historical records and were used to reconstruct the dead woman's face.

From the reconstruction, Thur and her colleagues concluded that Arsinoe had an African mother (the Ptolemies were an ethnically Greek dynasty). That conclusion led to splashy headlines suggesting that Cleopatra, too, was African.

But classicists say the conclusions are shaky.

"We get this skull business and having Arsinoe's ethnicity actually being determined from a reconstructed skull based on measurements taken in the 1920s?" wrote David Meadows, a Canadian classicist and teacher, on his blog rogueclassicism.

Not only that, but Cleopatra and Arsinoe may not have shared a mother.

"In that case, the ethnic argument goes largely out of the window," Cambridge classics professor Mary Beard wrote in the Times Literary Supplement in 2009.

Without more testing, the bones remain in identification limbo.

"One of my colleagues on the project told me two years ago there is currently no other method to really determine more," Thur told the News-Observer. "But he thinks there may be new methods developing. There is hope."

Ohio town still grieves one year after deadly shootings

Chardon High School remembersChardon High School remembersChardon, Ohio?A few red ribbons, tattered by the elements, still hang on trees along the streets of Chardon, Ohio. To some people in town, the ribbons are a necessary reminder of a shooting spree at Chardon High School a year ago that left three students dead and three others injured.

On Tuesday, just a day shy of the one-year mark of the tragedy, T.J. Lane pleaded guilty to three counts of aggravated murder and other charges in the Chardon shooting. Prosecutors say Lane fired 10 shots from a .22-caliber pistol at students milling in the school cafeteria the morning of Feb. 27, 2012.

After a year in which even deadlier mass shootings like those in Aurora, Colo., and Newtown, Conn., grabbed headlines, it could be easy to overlook the tragedy that shook Chardon, a middle-class community of 5,000 residents about 30 miles east of Cleveland.


If there are lessons to be learned from the students at the high school and the broader community, it?s that the emotional damage leaves lasting scars and heavy hearts do not heal quickly.

Four adults have committed suicide in Chardon, and there have been more than a dozen attempted suicides among students since the shootings, a school official said. Counseling sessions and lessons on detecting warning signs that friends, classmates and colleagues might be suffering have become part of classroom curriculum.

Chardon High School principal Andy Fetchik tried to put an upbeat face on a grim year during a press conference last week.

?I can assure you, we?re getting better,? Fetchik said. ?There?s a lot to be done. We have a strong and compassionate community surrounding us, and we?re getting better every day.?

One-year mark

What began as a typical winter day in Chardon turned into a deadly rampage when shots rang out around 8 a.m. Lane, then a 17-year-old junior, aimed his gun at randomly targeted students, authorities said.

Students Vincent "Danny" Parmertor, Demetrius C. Hewlin and Russell D. King Jr. were killed in the attack. Students Nick Walczak, Joy Rickers and Nate Mueller were wounded.

Police captured Lane in a neighborhood near the high school. Under questioning, he reportedly admitted to shooting the students. Before the case went to adult court last year, a juvenile court judge ruled that Lane was mentally competent despite evidence he suffers from hallucinations, psychosis and fantasies. Because he was a minor when the attack occurred, the death penalty was not a consideration.

With his grandparents and family members of the victims in court on Tuesday, Lane changed his plea from not guilty by reason of insanity to guilty. Dressed in a green open-collared shirt with close-cropped hair, Lane answered "yes" or "yes, your honor" to questions from the judge about the plea agreement. After a background review is completed, Lane will return to court on March 19, when Geauga County Judge David Fuhry is scheduled to sentence him.

Lane's attorney, Ian Friedman, said the teen had undergone psychiatric evaluation, but last week declined to discuss his client's emotional state and how he might reflect on the one-year mark.

?It?s a very delicate matter,? Friedman said. ?I don?t think it would be appropriate to comment on anything beyond where the case is procedurally.?

Geauga County Prosecutor James Flaiz did not return messages seeking comment on the case.

While a public trial could have shed light on the shooter?s motives, some community members say such details could have done greater emotional harm.

?There are very good lawyers in this case representing Lane and the prosecutor,? said Carmen Naso, a law professor at Case Western Reserve University in Cleveland. ?And, ultimately, the judge is going to decide what happens to this kid.?

No celebration

During a media briefing last week, reporters were asked to refrain from referring to Feb. 27 as the ?anniversary? of the tragedy, which could imply a sort of celebration. Reporters were asked instead to refer to the day as a ?one-year mark.?

Chardon High School students and faculty planned to observe the day by embarking on service projects. Some were making care blankets, like those distributed by volunteers after the tragedy. Others were crafting leashes for comfort dogs, like those brought to the school in the days after the incident.

Students also planned to take a memorial walk from the high school to the village square and host a candlelight vigil and concert.

?Danny, Demetrius and Russell were our classmates,? said Chardon High School senior Will Porter. ?For a lot of us, they were our friends. They?ll never be forgotten, and we hope to honor them through this day.?

Senior Jessie Mysyk said the tragedy has inspired a strong sense of unity at the school.

?There's never a time when a student would feel alone,? she said. ?Within the school, we are a community. We're all friends. We are a family. ... We are together."

Senior Jill Allenby said the killings had pushed students to move beyond typical teenage grievances.

?We don?t have the normal kind of drama or high school cliques that everyone sees,? Allenby said. ?When you walk through the halls, you see everyone and everyone says hello.?

Must love kids, not guns

After the slaughter of 20 first-graders and six faculty members at Sandy Hook Elementary in Newtown, Conn., in December, the National Rifle Association suggested placing armed guards at schools and possibly training teachers to shoot as the best way to avert such a tragedy in the future.

While the idea of arming teachers has some support in Chardon, school superintendent Joseph Bergant II says it won't happen.

Bergant said it was fine for teachers to learn to use weapons in their private time. But permitting a teacher to carry a concealed gun, which is legal in Ohio, will not happen in Chardon, he said.

?That defeats our purpose,? Bergant said. ?Our purpose is to educate children in a safe, caring environment. ? We are not going to put bars on the school buildings. We are not going to put an iron dome over the top.?

Fetchik, the high school principal, agreed. The school now has an armed ?resource officer??a police officer whose salary is paid with funds from the local government and donations to the community after the shooting.

?I don?t want guns in school,? Fetchik said. ?I want a trained resource officer. ? That gentleman is prepared to deal with using that weapon, (and) not just pointing and pulling the trigger."

About the red ribbons

Red ribbon hangs on a tree in Chardon, Ohio.Gestures like hanging a ribbon on a tree still serve as a haunting reminder to many. Recently, the city has removed the frayed and faded ribbons from all public places and suggested community members follow suit.

The ribbons have been collected by the school district and will be given to the families of the boys who died, Chardon City Manager Randy Sharpe said.

Many people, he acknowledged, wish the ribbons could stay. ?But, the ones that are tired and dingy reflect poorly on the community,? Sharpe said.

Officials said the city is looking to create a permanent memorial to honor the victims, the schools and community?a process that may take another one to two years.

Chardon resident Jamie Ward is among those people ready to move on. He and his wife, Sandy, had just moved to town shortly before the tragedy and have since had a son, Peter, now 10 weeks old.

?For me, the one-year mark is hard,? said Ward as he held his young son. ?A year later, I don?t want Chardon to always be associated with such a thing."

UAE bars British scholar over his views on Bahrain

DUBAI, United Arab Emirates (AP) ? The United Arab Emirates says it has barred a British scholar from entering the country because of his views on the uprising against fellow Gulf rulers in Bahrain.

Kristian Coates Ulrichsen, co-director of the Kuwait program at the London School of Economics, was due to speak Sunday at an Arab Spring conference co-hosted by the University of Sharjah.

He was turned back at Dubai's airport on Friday and organizers called off the event, citing restrictions on free speech.

The UAE's Foreign Ministry on Monday described Ulrichsen's work as critical of Bahrain's monarchy, which is closely backed by Gulf Arab states. It says "non-constructive" views on Bahrain are unwelcome amid talks seeking to ease the two-year-old unrest.

Bahrain's majority Shiites are seeking a greater political voice in the Sunni-ruled kingdom.

Beyond Structured Settlements: An ELNY Nightmare

While almost 1500 Executive Life of New York (ELNY) structured settlement shortfall payees await the outcome of continuing ELNY litigation, it is worth remembering how seriously Judge John Galasso's ELNY liquidation order and related restructuring agreement will impact some of these unfortunate individuals assuming his order and the restructuring agreement are ultimately upheld and implemented.

Glenn Arensdorf?

One such individual is Glenn Arensdorf. Glenn is a 49 year old Florida resident who is permanently and totally disabled. He cannot work in any capacity. Glenn's ELNY structured settlement payments are scheduled to be reduced by 58 percent which places him among the most drastically reduced of all the ELNY shortfall payees.?

Significantly, Glenn's structured settlement was funded in 1984 with two "buy and hold" annuities issued by ELNY and owned by Lumbermens Mutual Casualty Company, then known as Kemper Insurance Company, ("Lumbermens") one of the liability insurers in Glenn's personal injury case.

"Buy and hold" annuities, whereby an underlying insurer (in Glenn's case, Lumbermens) retained the liability for future periodic payments, and funded that liability through its ownership of qualified funding assets (in Glenn's case, two ELNY annuities), might appear advantageous compared with ELNY qualified assignments.

With qualified assignments, defendants and their liability insurers often seek to transfer their future liability for periodic payments to a qualified assignee which for ELNY annuities is First Executive Corporation. Unfortunately for ELNY qualified assignee payees, First Executive Corporation ceased to exist in 1991.?

Lumbermens, however, was ordered into rehabilitation July 2, 2012 so its financial and legal ability to fulfill its structured settlement obligations to Glenn are uncertain.

To add insult to injury: although Glenn has an application pending with the ELNY Hardship Fund, the fund specifically excludes applications for which the underlying insurer may still be responsible. To date, Glenn has not received any notification of an award or a rejection by the ELNY Hardship Fund.

Glenn, therefore, appears to face a "Catch 22" which he refers to as "my ELNY nightmare".

Fortunately, Glenn's attorneys believe he should qualify under the Illinois Life and Health Guarantee Fund (Lumbermens' home state) where the maximum combined coverage for both of Glenn's ELNY annuities appears to be $250,000. The Florida guaranty fund appears inapplicable because ELNY was never licensed to write business there.

Glenn's Personal Injuries

Three days after he began college in 1981, Glenn was a rear seat passenger in a one car accident in which a friend and driver lost control, hit a tree and died. Glenn was admitted to the hospital in an unconscious condition and was not expected to live. Although he survived, Glenn sustained traumatic brain injury, multiple fractures, and broken teeth among other injuries. He remained in a coma for five weeks. Glenn has no memory of either the accident or his first days in college.

Due to his brain injury, Glenn has subsequently developed permanent double vision and partial paralysis of facial muscles resulting in disfigurement. His left arm and hand are virtually useless. Glenn walks with a limp following 11 surgeries to his left leg. Both his left arm and left leg are noticeably smaller than his right as a result of muscle atrophy. Glenn also suffers psychological issues, neurological limitations, motor function impairment, cognitive limitations, impaired problem-solving skills, poor short-term memory, a short attention span and slow information processing speed - all as a result of his personal injuries.

Before his accident, Glenn played guitar and was a member of a rock 'n roll band - or, at least, that is what Glenn has been told. He cannot remember playing his guitar. After his accident, when Glenn finally returned home, he found a huge guitar amplifier and a Fender Stratocaster guitar. Having lost both his sense of rhythm and use of his left hand, Glenn became so depressed, he sold his amplifier and guitar "for pennies".

"Glenn's World"

With support and encouragement from his family, Glenn has learned to adapt to his handicapped status and has made progress toward living independently. Glenn lives in a gated community attached to a plaza with a grocery store, several restaurants, and various professional offices. He refers to his community as "Glenn's World" where he serves as an inspiration to other disabled persons who endeavor to live an independent life style.

Every morning, Glenn rides his three-wheel bike to his favorite restaurant, Pete's Place, where he eats breakfast and socializes with the staff and regular customers "by telling them bad jokes". He visits a chiropractor three times each week for treatment of the scoliosis he developed from accident-related injuries. Everyday, Glenn also visits his other favorite restaurant in the plaza, Duffy's, where he helps the staff set up for a busy lunch hour by folding napkins and telling more bad jokes. Although he cannot cook, Glenn generally returns home in time to prepare a sandwich for lunch.?

During the afternoon, Glenn watches TV or reads his emails. Then he rides his bike back to the plaza for dinner at one of several restaurants. The staff of these restaurants have known Glenn for 20 years. When Glenn orders his dinners "chop chop", they help cut up his meals because he is unable to do so himself. Like other brain injured individuals, Glenn's life requires and benefits from similar daily and weekly routines. This includes Glenn's nighttime routine when, due to back pain, he always sleeps on his left side on the right side of his bed.

The ELNY Liquidation

Glenn's ability to sustain his life in "Glenn's World" depends upon his monthly ELNY annuity payments. His financial needs are extraordinary and his limitations profound. Glenn is completely reliant and dependent on others to do what he cannot do for himself. Besides his ELNY annuity payments, the only income Glenn receives is a monthly Social Security Disability payment in the amount of $720.

Glenn is presently being treated by a psychologist for the emotional stress and anxiety created by the ELNY liquidation. He suffers from depression and has difficulty sleeping at night. Glenn does not understand why the State of New York or other insurance companies did not bail out ELNY or why ELNY shortfall payees with catastrophic injuries will be forced to exist on budgets that do not meet their needs. Although Glenn would like to be part of an ELNY support group with other shortfall payees, Judge Galasso has ruled that Glenn and other shortfall payees cannot have access to each others names and contact information.

Some proponents claim that structured settlements are "the ultimate safeguards to guarantee the long term financial health of people harmed in accidents". For Glenn Arensdorf and similarly situated ELNY shortfall payees, however, the structured settlement system has failed them. To protect their rights, they have been forced to challenge the legality and unfairness of Judge Galasso's liquidation order and restructuring agreement against long odds and powerful opponents.
